1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you (whether personally or on behalf of an entity) and QuizzFlix ("QuizzFlix," "we," "us," or "our") concerning your access to and use of the QuizzFlix website, mobile application, and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

  • Posting the updated Terms on the Service with a new "Last Updated" date
  • Sending notification via email to registered users
  • Displaying a prominent notice on the Service

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms. You are responsible for reviewing these Terms periodically.

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3.2 Account Creation

To access certain features of the Service, you may be required to create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

3.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe:

  • Violates these Terms
  • Is harmful to other users, third parties, or our business interests
  • Violates applicable laws or regulations

4. Intellectual Property Rights

4.1 Our Content

Unless otherwise indicated, the Service and all content, features, and functionality (including but not limited to quizzes, questions, answers, text, graphics, logos, images, audio, video, software, and data compilations) are owned by QuizzFlix or our licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use only.

4.3 Restrictions

You may not:

  • Modify, copy, distribute, transmit, display, reproduce, publish, license, or create derivative works from any Content
  • Use any automated system (including robots, spiders, or scrapers) to access the Service
  • Frame or mirror any part of the Service without our prior written authorization
  • Reverse engineer, decompile, or disassemble any software or technology used in the Service
  • Remove or modify any copyright, trademark, or other proprietary notices

5. User-Generated Content

5.1 Content You Provide

You may be able to create, submit, or post content on the Service, including quiz submissions, comments, ratings, and other materials ("User Content"). You retain ownership of your User Content, but you grant us certain rights as described below.

5.2 License Grant

By submitting User Content, you grant QuizzFlix a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with operating and providing the Service.

5.3 Content Standards

You represent and warrant that your User Content:

  • Is accurate and not misleading
  • Does not infringe any third party's intellectual property, privacy, or other rights
  • Does not contain viruses, malware, or other harmful code
  • Does not violate any applicable laws or regulations
  • Does not contain offensive, defamatory, obscene, or hateful content

5.4 Content Monitoring and Removal

We reserve the right (but have no obligation) to:

  • Monitor, review, or edit User Content
  • Remove or refuse to post any User Content for any reason
  • Terminate or suspend access for users who violate these content standards

We do not endorse or guarantee the accuracy, integrity, or quality of User Content.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

6.1 Illegal and Harmful Conduct

  • Violate any applicable laws, regulations, or third-party rights
  • Engage in fraudulent, deceptive, or manipulative practices
  • Harass, threaten, intimidate, or harm others
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to the Service or other users' accounts

6.2 Service Interference

  • Interfere with or disrupt the Service or servers/networks connected to the Service
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service
  • Attempt to circumvent any security measures or access controls

6.3 Commercial Misuse

  • Use the Service for unauthorized commercial purposes
  • Sell, resell, or exploit any portion of the Service without our express written permission
  • Use information obtained from the Service for commercial solicitation

6.4 Content Violations

  • Upload or transmit viruses, malware, or other malicious code
  • Collect or harvest personal information from other users without consent
  • Post spam, unsolicited promotions, or advertisements

7. Third-Party Links and Services

The Service may contain links to third-party websites or services that are not owned or controlled by QuizzFlix. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party content or services.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data collection and use practices.

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

  • The Service will function uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service is free of viruses or other harmful components
  • Results obtained from the Service will be accurate or reliable

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL QUIZZFLIX, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the Service
  • Any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your content
  • Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU HAVE PAID US IN THE PAST 12 MONTHS.

9.3 Exceptions

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the limitations above may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless QuizzFlix and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

  • Your violation of these Terms
  • Your use of the Service
  • Your User Content
  • Your violation of any rights of another party

11. Dispute Resolution

11.1 Informal Resolution

Before filing a claim, you agree to contact us at help@topquizzes.es and attempt to resolve the dispute informally by providing a brief written description of the dispute and your contact information.

11.2 Jurisdiction and Venue

Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Spain. You agree to submit to the personal jurisdiction of such courts.

For consumers within the European Union, nothing in these Terms affects your rights under applicable EU consumer protection laws, and you may bring proceedings in the courts of your country of residence.

11.3 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions.

12. Term and Termination

12.1 Term

These Terms remain in full force and effect while you use the Service.

12.2 Termination by You

You may terminate your account at any time by contacting us at help@topquizzes.es or through your account settings.

12.3 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

12.4 Effects of Termination

Upon termination:

  • Your right to use the Service will immediately cease
  • We may delete your account and User Content
  • Sections that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnification, and dispute resolution

13. Copyright Infringement Policy

We respect intellectual property rights and expect users to do the same. If you believe that content on the Service infringes your copyright, please contact our designated Copyright Agent at help@topquizzes.es with the following information:

  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the allegedly infringing material and its location
  • Your contact information (name, address, telephone number, email)
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

We may terminate accounts of repeat infringers.

14. Additional Terms

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and QuizzFlix.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

14.6 Headings

The section headings in these Terms are for convenience only and have no legal or contractual effect.
